Expert group for misconduct in research at the Central Ethical Review Board*

As of 1 January 2010, the Central Ethical Review Board (CEPN) has a new task. In accordance with Section 9 of the Statute (2007:1068) containing instructions for the Central Ethical Review Board an expert group for misconduct in research has been appointed at CEPN. The expert group shall, at the request of a university or other Higher Education Institute (HEI) that has the State as principal - and which is covered by the Higher Education Act (1992:1434) - issue a statement on cases concerning investigations of suspected misconduct in research, artistic research and development work (SFS 2013:507).

The expert group for misconduct in research consists of a chair and four other members. The chair must be or have previously been a permanent judge. The other members must have academic expertise in different fields of research. One of the members must be an ethics expert. All members of the expert group have personal substitutes. All members and substitutes are appointed by the Government for a determined period ( Sections 9-11 of the Statute containing instructions for the Central Ethical Review Board).

The HEI's investigative responsibility

In accordance with Chapter 1, Section 16 of the Higher Education Act (1993:100), a HEI which via a report or other means is made aware of a suspicion of misconduct in research, artistic development or other developmental work at the HEI must carry out an investigation. During the investigation, the HEI may obtain a statement from the expert group for misconduct in research at the Central Ethical Review Board. If the person who reported the suspicion of misconduct - or the person suspected - so requests, the HEI shall obtain this statement. It is however not necessary to obtain a statement if the HEI deems that it is clearly unnecessary.
